Passenger Waiver & Release of Liability Roko Pearls Australia Pty Ltd – Boat Cruise Participation Agreement By booking this tour, I acknowledge and agree to the following: 1. Assumption of Risk I understand that participating in a boat cruise involves inherent risks, including but not limited to: • Boarding from a beach (which may require walking through shallow water) • Slippery surfaces, sudden vessel movements, and changing weather conditions • Possible injury from fishing equipment, marine life, or water activities 2. Fitness to Participate I confirm that I am physically fit to board and disembark the vessel, and to participate in cruise activities. I understand that a minimum level of mobility is required and that I may get my feet wet during boarding. 3. Release of Liability I release and hold harmless Roko Pearls Australia Pty Ltd, its employees, agents, and affiliates from any and all liability for personal injury, property damage, or wrongful death arising from participation in this cruise, including negligence or equipment failure. 4. Medical Treatment I acknowledge that the vessel has limited medical facilities and that emergency treatment may be delayed until I can be transported to shore. I accept this condition and agree to seek medical advice if needed before participating. 5. Personal Belongings I understand that Roko Pearls Australia Pty Ltd is not responsible for loss, theft, or damage to personal belongings brought aboard. 6. Compliance with Crew Instructions I agree to follow all safety instructions and directions given by the crew. Failure to comply may result in removal from the vessel without refund. GENERAL DISCLAIMER At the time of publication, all tours timetables, fares, accommodation details, and tour information are accurate. However, these are subject to change—sometimes without prior notice. All services and reservations are governed by the terms and conditions of their respective providers. Roko Pearls Australia Pty Ltd accepts no responsibility for: • Misrepresentation or unintentional omissions • Additional costs incurred due to unforeseen circumstances, including adverse weather • Unused services for which refunds may not be available We strongly recommend that all passengers obtain comprehensive travel insurance to cover unexpected disruptions. Booking Credits & Vouchers • Booking Credits, Gift Vouchers or Complimentary Travel Vouchers – Must call 04 7482 0438 to redeem – Cannot be used for online payment – Any travel voucher booking charged at full fare Discounted/Promotional Fares • Promotional fares are subject to availability. • All discounted bookings are non-refundable and must be paid in full at time of reservation. • No changes or cancellations are permitted. • If the original promotional fare isn’t available on your new departure, additional charges may apply to secure the booking. Refunds and Cancellation Policy • All fares are non-refundable. Changes and cancellations are permitted if requested prior to your sailing’s scheduled departure time. No administration charges apply. o Changes and cancellations can only be made by calling 04 7482 0438 during office hours or by email info@rokopearls.com.au • Office hours are: o Monday to Sunday 8 am – 5 pm • When cancelling a booking, any remaining balance will be held in credit to be used within 12 months from date of purchase. All future bookings utilising such credit can only be made via calling our booking team and at the applicable fare levels. Promotional fare reservations cannot be made utilising a credit. • If you do not travel and do not notify us prior to the sailing’s scheduled departure time, you will forfeit the fare paid. • For further information: o Email info@rokopearls.com.au • Your new fare will be at least the price of the original fare and may be more in the event that fare rises occur or when travelling on a promotional fare. You must pay this fare difference when you re-schedule your booking. This policy is subject to the provisions of the Trade Practices Act 1974 (as amended). Travel Insurance • Holiday plans can be disrupted, and cancellation fees can be expensive. • Travel insurance is inexpensive and highly recommended. • Consider obtaining insurance prior to your scheduled trip. • Travel insurance is not provided by Roko pearls Australia Pty Ltd. Security • Reservations made via the website or our reservation team are processed on a secure server. • Secure Sockets Layer (SSL) encrypts the information you send through this website. • Roko Pearls Australia Pty Ltd makes no warranty regarding the strength or effectiveness of that encryption and is not responsible for events arising from unauthorized access to the information you provide. • Card details processed on our website are handled via Rezdy. Your card details are kept secure at various stages of payment: 1. Card details are encrypted on your device using a 2048-bit SSL version 3 certificate from GeoTrust. 2. These encrypted details are sent safely and securely to servers where they are decrypted. 3. Payment details are stored in memory for up to 2 minutes while communication begins with our bank’s gateway, after which they are removed immediately. Luggage Policy • Standard passenger hand luggage is limited to one piece per person, with maximum dimensions of 56 cm (L) × 36 cm (W) × 23 cm (D). • Hand luggage must be kept with the passenger at all times and is carried at the passenger’s own risk. • Roko Pearls Australia Pty Ltd accepts no responsibility for loss, damage, or theft of hand luggage. Dangerous Goods • No dangerous goods of any kind are allowed on board. Boarding conditions 1. Check-in opens 15 minutes before departure to allow for ticketing and safe loading. 2. Boarding may be refused for passengers that do not meet the check-in deadline. 3. Smoking is strictly prohibited on board at all times. 4. Children under 16 must travel with an accompanying adult; unaccompanied minors are not permitted. 5. Only passengers whose names appear on the manifest may travel. o Transfers of travel arrangements require prior authorization. Conditions of Travel and Booking 1. Travel must be completed within 12 months of payment. These conditions are governed by and construed in accordance with the laws of the Commonwealth of Australia and any Australian State. 2. Roko Pearls Australia Pty Ltd reserves the right to cancel or vary this service in any way, or to substitute any vessel or other means of transport, without incurring any liability. 3. Fares, timetables and routes are subject to alteration without prior notice, at the discretion of Roko Pearls Australia Pty Ltd. 4. Roko Pearls Australia Pty Ltd shall not be liable for any loss or damage arising from: o Cancellation or abandonment of the service o Deviations or delays for any cause o Consequential damages, including the cost of accommodation or alternative travel arrangements Any additional expenses remain the passenger’s responsibility. 5. Roko Pearls Australia Pty Ltd accepts no responsibility for injury or death of a passenger on this service—whether caused by negligence, vessel malfunction or other cause—except to the extent that exclusion of such liability is prohibited by law. Notice to Passengers Roko Pearls Australia Pty Ltd (“the carrier”) CONDITIONS OF CARRIAGE “PASSENGERS” 1. The ticket is issued and carriage service provided on the terms of carriage which include the booking confirmation and the carrier’s website prior to boarding. 2. The ticket constitutes acceptance by the passenger of these terms and conditions. If the purchaser is not the travelling passenger, they act as the passenger’s agent. 3. No carrier agent is liable for inaccuracies in information about the carrier, its services or pricing. 4. The carrier is not a common carrier and may refuse to carry any person without giving reasons. 5. Cancellation or delay may occur due to loading restrictions, industrial disputes, unsuitable weather or other operational factors. The carrier may also cancel or vary schedules for any reason. 6. Passengers must comply with all applicable laws, regulations and instructions from the carrier and its representatives. 7. The carrier may deny boarding or remove passengers who, in a representative’s opinion, breach these terms or are under the influence of drugs or alcohol, or whose behaviour jeopardises safety, comfort or property. 8. The carrier, its servants and agents shall not be liable for loss, damage, delay or consequential loss of any kind arising directly or indirectly from negligence or omission in providing or failing to provide any service (including embarking and disembarking). 9. Any implied condition or warranty is excluded unless legislation prohibits such exclusion. Where mandatory provisions apply, the carrier’s liability is limited to the extent allowed by law. 10. To meet insurance and safety requirements: o Standard hand luggage (one piece per person, max 56 cm L × 36 cm W × 23 cm D) is allowed at the passenger’s own risk and must remain with them at all times. o The carrier accepts no responsibility for loss, damage or theft of hand luggage. The carrier reserves the right to alter times and/or fares without prior notice.
